Boom - -Boom - - - Boomerang!

Anne Marie MacInneswas appointed to represent Lisa McCarthy at hearings at which Lisa could not be present because she was in Florida or Toronto. While Lisa McCarthy was in Florida, instead of asking that the hearing be adjourned until her client could be there, MacInnes went ahead and (mis)represented her, even while acknowledging that she had no authority to do so because Lisa was in another jurisdiction. While Lisa McCarthy was in Toronto, she specifically told MacInnes to ask Social Worker Arlene MacIsaac her opinion about whether Emma should be returned to the McCarthys. MacInnes said she could not ask such a question because it might jeopardize MacIsaac's job?!?!!

Lo and behold, right after Arlene MacIsaac testified, with testimony that was favourable to the McCarthys, MacIsaac was fired by CAS and coerced to sign illegal papers prepared for CAS by -- gues who - ? - Anne Marie MacInnes.

Mr. and Mrs. McCarthy have in their possession disclosure tapes of the hearings (the tapes from September 10 and 27, 1997. They received the tapes from Family Court workers who were filling in for the regular staff who were in Halifax. The regular court workers were horrified to learn that these tapes had been heard by the McCarthys and asked for their immediate return. Everyone should be embarrassed. The tapes clearly present MacInnes, who is supposed to be representing Lisa McCarthy joking disparagingly about her client to court workers and the CAS lawyer. A reputation is not like a boomerang, she says, regarding Lisa's past difficulties: "it doesn't come back to you." The malice drips from her voice. This is a strong indication that MacInnes is a reckless and ambitious person who shares ethics with Nancy Radcliffe.

When Lisa first tried to fire her, MacInnes told her that if she did that, she (Anne Marie) would tell the judge that Lisa had given up her parental rights to Emma.

Anne Marie MacInnes is still practicing law with Cape Breton Legal Aid. We have to ask how Cape Breton CAS qualified for the services of a legal aid lawyer to draw up the blackmail papers on Arlene MacIsaac. Or was it just a favour she performed for Frank Sampson because she was really dedicated to making sure that Lisa and Bernard McCarthy did not get Emma back? injusticebusters wonder if these two know each other.

We're going to try to make sure that this boomerang lands right back in the hands of Frank Sampson and Anne Marie MacInnes.

 Greg Walen has variously represented the children in the Foster Parent's case, Sgt. Brian Dueck, and Social Services, sometimes all at the same time. He didn't see any conflict. We should point out that he is no longer handling all these files but it was an uphill battle to have him withdrawn as Dueck's counsel in the civil claim.

Walen strode self-importantly into the courtroom and informed the judge that he had "Orders from the Minister (of Social Services)" to stop any attempts to produce them before Rick Klassen received the go-ahead from Queen's Bench Judge Peter Dielschnieder to have the Ross children produced for his criminal defamation trial

This imperious form of lawyering works with some judges, but most know that Canada is no longer a colony and that the courts are independent of the legislature.
