 Ruling in Satellite case

Today at Valleyfield Quebec, the Honourable Judge Michel Mercier of the Quebec Provincial Court rejected all charges under the Criminal Code against Mr. Reginald Scullion and his wife Mrs. Frances Callan on the basis that they had not committed any crime under Canada's laws.

After hearing 23 days of court testimony over the last two years with the defence producing no witnesses and the crown presenting expert after expert the Honourable Judge Michel Mercier came to the conclusion that no charges should ever have been laid against these defendants as no crime was committed by them. This is effectively the same conclusion that some 10 other Judges have arrived at under the RC Act in courts across the country that include Superior courts in British Columbia, Saskatchewan, Manitoba, Ontario and Nova Scotia as well as three other Provincial Judges in Quebec and all the way up to the Appeals Court of British Columbia in a very important decision.

It is difficult to understand HOW the RCMP can seize millions of dollars in equipment, money and other assets belonging to both a company and 2 defendants when in fact they have committed no crime according to a well reasoned court decision made after hearing 23 days of Crown witnesses put on by the Government. The defence chose NOT to put on any witnesses at all preferring to rely on simple legal arguments and recent jurisprudence that were VERY EFFECTIVE.

In fact the defendants had been charged with "theft" of the 10,000 or so access cards seized but when they produced receipts about a year later in court showing they were purchased on their behalf from DirecTv and THEN the RCMP did an investigation, they had to admit to the court that their investigation showed that the cards were purchased properly and in fact no "theft" had taken place.

Yet citizens would normally assume that the RCMP would do their investigation BEFORE charging defendants, not one year AFTER they have been charged.

All of this and the evidence presented in court leads to a conclusion that the Government may actually have a specific agenda in pressing these charges. Some of that agenda may well be Political too, which is not proper in Canada. While MANY defendants have been charged under the RC Act for the exact same actions right across Canada (these defendants Scullion, Callan, for Vcipher and Avantec, were charged under the Criminal Code) and that was mainly because (in our opinion) the Crown might have received 1/3 of the money and property seized due to a "secret agreement" arrived at with the Federal Crown and the RCMP. Not a single defendant in all these DirecTV® issues has been found guilty anywhere across Canada. It was discovered that in fact DirecTV® are NOT a lawful distributors in Canada and some courts mentioned that DirecTV® may well be the ones who act criminally in defiance of Canadian law. This court mentioned this fact as well in the judgement.

Now these defendants who have been "acquitted" by the court now still have to go back to a court and file a 490 brief to reclaim the vast amount of property, funds in their bank accounts and computers and other items seized at their home by the RCMP over 2 years ago on November 4, 1998.

The Judge went so far as to state that one would be quite legitimate to wonder WHY time, money and effort was spent on this preliminary hearing and if the hearing was in fact legitimate. This in view of the fact that the highest court in Canada, the SUPREME Court of Canada had ruled on this matter in 1990 in the case of R. v. Fulop which the defence submitted. A Nexis MUST be made between a lawful fee and the right to collect the lawful fee and that the crown knew or should have known that this concerned a foreign distributor who COULD NOT collect a lawful fee or charge because they are NOT authorized to do so in Canada.
